Sound libraries and samples libraries purchased on Samplestar.com are licensed not sold to you by Samplestar.com. Samplestar.com is the original owner or licensee of the original audio recordings. Once you have purchased and downloaded a sample library from Samplestar.com you have purchased a single user license to use these sounds in combination with other sounds within your own musical compositions. You are entitled to release these compositions commercially without payment of any further fees or royalties for such usage. However, you may not use Samplestar.com sounds and content in isolation (ie, when not used within your own mixed musical compositions) or as part of a commercially released project (ie, you cannot use the sounds to make another sample library, or for multimedia production unless as part of a composition with other sounds). This license also expressly forbids resale, re-licensing or other distribution of these sounds, either as they exist, or any modification thereof. You cannot sell, loan, rent, lease, assign or transfer all or any of the enclosed sounds to another user.
You accept and acknowledge that Samplestar.com has a proprietary interest in all sounds contained within this website and that any use by you that intends to frustrate the purpose of this agreement, including but not limited to selling, renting, or otherwise distributing the sounds would cause irreparable injury to Samplestar.com in a way that could not be adequately compensated by damages. You agree that, in the event of such improper use, Samplestar.com shall be entitled to an immediate injunction without the requirement of posting a bond.
Samplestar.com expressly disclaims all warranties of conditions of any kind, express or implied, including without limitation, the implied warranty of title, non-infringement, merchantability and fitness for a particular purpose. You agree that Samplestar.com cumulative liability with respect to any claims made in relation to or arising out of this agreement on any theory or basis will not exceed the purchase fee paid by you to Samplestar.com.
